SMS Terms of Service

This SMS Terms of Service ("Agreement") governs your participation in the SMS messaging program (“Program”) offered by Bella & Bear (“Company,” “we,” “our,” or “us”). By opting in to receive SMS messages from us, you agree to these terms.

1. SMS Messaging Program Description

By providing your phone number and opting into the Program, you agree to receive:

  • Automated promotional and transactional text messages

  • Messages including order updates, offers, and cart reminders

  • Message frequency that varies based on your activity and preferences

These messages may be sent via automated systems, including short-code and long-code SMS tools.

2. Consent and Opt-In

You may opt into our SMS Program through:

  • Checkout forms

  • Pop-up forms or embedded sign-up boxes

  • Other digital opt-in methods

By opting in, you confirm you are the authorized user of the mobile number provided and that you are at least 18 years old or have the consent of a parent/guardian.

4. Opt-Out and Support

You may cancel at any time by replying STOP to any text message. You will receive one final message confirming your opt-out.

5. Data Sharing and Privacy

We use third-party providers such as Klaviyo to manage and send SMS messages. Your mobile number and engagement data (clicks, replies, unsubscribes) may be shared with these partners solely to provide SMS services and measure performance.

We do not sell your mobile data.

6. Your Responsibilities

You agree to:

  • Provide accurate, current mobile contact information

  • Use the Program only for lawful purposes

  • Not spoof, impersonate, or misrepresent your identity

7. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.
Messaging availability may vary by location and carrier.

8. Termination and Changes

We reserve the right to change or terminate the SMS Program or this Agreement at any time. Updated terms will be posted on this page with the new effective date.

Your continued participation in the Program constitutes acceptance of the updated terms.
